Florida Highway Patrol Trooper Scott Kuntsmann, 46, was arrested for perjury after an investigation by the Florida Department of Highway Safety and Motor Vehicles. The investigation determined that Trooper Kuntsman fabricated arrest records and was untruthful during a deposition, according to ABC News 10 Tampa Bay.
Dash camera video from 2011 shows Kuntsmann pull over Robert Culbertson, 71, and ask him a series of questions to determine if the driver had been drinking. Culbertson admitted to having one beer three hours earlier. Kuntsmann and another officer can be heard on video agreeing they didn’t smell alcohol, but the report Kuntsmann wrote said otherwise.
Additonally in 2011, Kunstmann pulled over a woman and administered field sobriety exercises. He reported that she was belligerent and cursing, however the video did not show her behaving in that manner.
I am most certain that the allegations facing Trooper Kunstmann come as a shock to most observers. As a former prosecutor and current criminal defense attorney I have come into contact with literally thousands of law enforcement officers. Most are good, honest people, but they are all human and have flaws. We may never know why Trooper Kunstmann chose to lie, but he is nonethless entitled to the same protections under the law as those he formally arrested.
