What Is Included in an Equitable Distribution Scheme?

Equitable Distribution refers to the distribution of Marital Assets in Divorce proceedings. Generally, these are assets that have been acquired during your marriage. This also includes the appreciation of any nonmarital assets if the enhancement in their value is the result of marital efforts or labor. Marital Assets do not include gifts from third parties during the marriage, inheritance, assets owned prior to the marriage, or assets acquired after the date of filing.

What Factors Does the Court Take into Consideration When Awarding Assets?

There are many factors the court takes into consideration when determining which spouse to award a certain asset to.  Some of the more commonly considered factors include:

• The duration of the marriage
• The economic circumstances of each party
• The contribution of one spouse tot eh personal career or educational opportunity of the other spouse
• A spouse’s contribution to the appreciate, acquisition, enhancement, and product of income from an asset.
• A spouse’s contribution to the marriage, including to the care and education of the children and services as a homemaker.
• The intentional dissipation, waste, depletion or destruction of marital assets within two years of filing for divorce.
• Any other factors the court determines are necessary to do justice and equity between the parties
